The Residential Tenancies Act is the legislation that stipulates all rights and responsibilities for tenants and landlords.
If you have signed a tenancy agreement that’s inconsistent with the Residential Tenancies Act 1986, the Act overrides your agreement. E.g. even if your tenancy agreement says you must leave on a month’s notice, you are still entitled to 90 or 42 days notice (depending on the circumstances). If you don’t have a written agreement, you still have all the same minimum rights that tenants have under the Residential Tenancies Act.
